Abstract

Alternative means of conflict resolution, especially Mediation, creates opportunities for persons experiencing family conflicts to build solutions, transforming the old paradigm of just waiting for the judicial decision to resolve the impasse. This paper analyzes the importance of the qualification of the judicial mediator, identifying which competencies and skills are necessary in their training to work in Family Courts. It describes the model of practical training of the judicial mediator of the Cooperation Project signed between Mediativa – Instituto de Mediação Transformativa, SP, and CEJUSC Santo Amaro, SP, as an example of a model based on the improvement of the mediator. A concrete situation of family conflict is presented, the analysis of which allowed reflections on the role and training of the mediator. Current challenges point to changes that can contribute to the construction of a new mentality more focused on pacification and social cohesion.
