Dysfunctional dynamics in child custody cases and allegations of parental alienation: a systemic approach

Abstract

Since the enactment of the Brazilian parental alienation Act (Act n. 12.318/2010), this theme’s popularity and its allegations in judicial child custody cases have increased. However, critical, technical and ethical discussions about the application of parental alienation assumptions in this context are still necessary. For this reason, this paper presents a qualitative case study based on two cases evaluated by a psychosocial team in a Brazilian court. The article’s discussion uses a systemic approach to parental alienation allegations in judicial child custody cases. This approach pointed out the complexity of each case presented and circular causality of those dynamics usually identified as ‘parental alienation’. This paper also makes systemic reflections about the role and duties of psychosocial professionals when evaluating such cases.
